Bihar is the first state to go to polls during the Covid-19 pandemic and amid preparations being made by the Election Commission (EC) for holding elections two months from now, the Supreme Court on Friday dismissed the first sign of resistance to EC’s decision. A three-judge bench headed by Justice Ashok Bhushan dismissed a PIL filed by a Muzaffarpur resident Avinash Thakur seeking postponement of Assembly elections due in October this year.

Pointing to the rising number of Covid-19 cases in the state and floods which have displaced lakhs of residents in 14 districts of north Bihar, the petition stated that at present, the health of citizens should be the paramount consideration of the state authorities. The petition cited a news clipping of August 12 where the Chief Election Commissioner was quoted saying that elections to the 243-member Assembly in Bihar will be held as per schedule.
